Outgoing President Rodrigo Duterte’s statement that two “Dutertes” will hold the country’s presidency and vice-presidency for 11 days due to the unprecedented early inauguration of his daughter, Vice President-elect Sara Duterte-Carpio, is misleading.

Although this is the first time in Philippine history that an incoming vice president is the son of an outgoing president, their terms of office do not overlap.

STATEMENT

During his keynote speech at the groundbreaking ceremony for a new sports complex in Bataan on June 17, the president mocked the five members of the Garcia political dynasty in attendance for “getting everything [of the positions]in the provincial government. He joked:

I love your leadership, Garcia (I am surprised by their leadership, they all belong to the Garcia family). with us too (We are the same). You know there is a strange coincidence in our history. Maybe it would be the first time; I don’t know. He added:

Although Duterte-Carpio was sworn in as vice president on June 19, she will remain mayor of Davao City until her term ends on June 30.

Section 4, Article VII of the 1987 Constitution clearly states that the incoming vice president can only take office “at noon on the 30th day of June following the day of the election and shall terminate at noon on the same date six years later.”

Duterte-Carpio acknowledged this at a press conference on June 20 when asked who he would appoint to the Vice President’s Office, saying his term would only start on June 30. This is the first time since the ratification of the 1987 Constitution that an incoming vice president has been sworn in before the term begins.

On June 19, the president’s daughter was sworn in as the country’s 15th vice president in ceremonies in her hometown of Davao City. Her running mate, President-elect Ferdinand “Bongbong” Marcos Jr., son and namesake of the late dictator, will be inaugurated in front of the National Museum in Manila on June 30.

Former election official George Garcia said in May that early swearing-in is not illegal “as long as the assumption [to office] It would be at noon on June 30.”
